1. SMS Consent Terms

By opting into SMS communications from DumpStars Indiana LLC ("Company"), you ("Customer") consent to receive recurring SMS messages including but not limited to order confirmations, appointment reminders, service notifications, marketing messages, account updates, and operational notices.

2. Dumpster Rental Terms of Lease

DumpStars Indiana LLC provides temporary roll-off container services. By placing an order, Customer agrees to the following terms:

Service will be delivered to the address provided by Customer on the date scheduled.
Customer may cancel an order with a minimum of 4 hours' advance notice. A $50 cancellation fee applies to orders canceled with less than 4 hours’ notice.
Rentals include a standard rental term. Additional rental days are subject to availability and will be charged at $15.00 per day.

3. Weight Allowances & Overage Fees

C&D and MSW Materials:

Weight limits are based on container size. Exceeding these limits will result in a $75.00 per ton overage fee:

15-yard: 4,000 lbs (2 tons)
20-yard: 6,000 lbs (3 tons)
30-yard: 10,000 lbs (5 tons)
40-yard: 12,000 lbs (6 tons)

Concrete & Dirt:

Unlimited weight permitted only if material is clean (i.e., no trash or other contaminants). If trash is present, the standard overage policy applies.

15-yard and 20-yard: Allowed to fill to the brim only.

Additional Charges:

Dry run (unable to deliver/retrieve due to access issues): $75 - $125
Overfilling above the container's rim: $50 - $200 depending on severity
Handling restricted materials: 3rd party disposal fees may apply

4. Prohibited Waste

Customer shall not dispose of the following in DumpStars containers:

Hazardous, flammable, infectious, biohazardous, or radioactive waste
Medical, chemical, or toxic materials
Liquids, electronics, batteries, tires, appliances, sludge, or yard waste over 3 feet in length

Violation may result in:

Refusal to collect the dumpster
Additional handling and disposal fees
Termination of service without refund

5. Customer Responsibilities

Customer assumes full responsibility for:

Staying within weight and fill limits
Scheduling timely pickup
Ensuring the dumpster is not overloaded or misused
Inspecting the dumpster upon delivery for pre-existing damage

Customer is liable for all damages incurred to the container while in their possession, including but not limited to:

Structural damage
Graffiti or unauthorized markings
Fire or burn damage
Damage due to improper loading or movement

6. Damage Waiver & Assumption of Risk

Customer acknowledges that delivery, placement, and pickup of dumpsters may cause damage to:

Driveways, sidewalks, parking lots, curbs, lawns, landscaping, irrigation, and access paths

Customer agrees to assume all risks associated with:

Weight and pressure of the container
Delivery/removal vehicle access
Underground utilities or unmarked obstructions

DumpStars Indiana LLC is not liable for any such damage, and Customer waives any and all claims.

7. Payment Terms

Residential Customers: Prepayment by debit or credit card is required. The card will be retained on file until all final charges are resolved.
Additional Fees: Any fees incurred during or after the lease term (overages, damages, extra rental days, dry runs, prohibited waste handling, etc.) will be billed to the card on file.
Responsibility: If payment is unsuccessful, Customer agrees to pay the full outstanding balance immediately and is liable for all legal, administrative, and collection costs incurred.
Commercial Accounts: With prior approval, commercial accounts may be granted Net 30 terms. Approved clients may pay by check. Late payments may result in interest, suspension of service, or collection action.

8. Indemnification & Governing Law

Customer agrees to indemnify, defend, and hold harmless DumpStars Indiana LLC and its agents, employees, and affiliates from any and all claims, damages, losses, liabilities, or costs arising from:

Customer's use, misuse, or placement of the dumpster
Disposal of prohibited materials
Injury or damage caused to persons, property, or the environment

This Agreement shall be governed in accordance with the laws of the State of Indiana. Venue for any dispute shall lie exclusively in Howard County, Indiana.

9. Entire Agreement

This Terms & Conditions document, along with any executed service contract or invoice, constitutes the entire agreement between the parties. It supersedes any prior oral or written agreements and may only be amended in writing signed by an authorized representative of DumpStars Indiana LLC.

By placing an order or signing a service agreement, Customer acknowledges they have read, understand, and agree to be legally bound by the terms herein.
